Personal data is information that determines the identity of the data subject or at least makes it determinable. This includes all data containing individual details about personal or factual circumstances, such as name, address, e-mail address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of individuals, and biometric data such as fingerprints. Sensitive data, such as health data or data related to criminal proceedings, may also be included. Any request for access, deletion, rectification, objection and/or see data transfer can be addressed to the above mentioned address of VALFORD Attorneys. Furthermore, we inform you that in the course of our legal representation and support, factual and case-related information is regularly obtained from third parties. As a matter of principle, the data we collect from you or from third parties is subject to our attorney-client confidentiality obligation.  

 

2. Use of data 

 

We will not process the data provided to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. The processing of the data is also based on our legitimate interests. These legitimate interests include, in particular, defending against liability claims, ensuring data integrity and security, and promoting economic advancement. The personal data we collect is necessary both for the performance of the mandate agreement and for the fulfillment of the obligations incumbent upon us (esp. with regard to KYC requirements for the prevention of money laundering and terrorist financing). Unless otherwise stated, the provision of this data is therefore necessary for the conclusion of the contract. 

 

3. Transmission of data to third parties 

 

In order to fulfill your assignment, it may also be necessary to transfer your data to third parties (eg counterparties, cooperation partners, substitutes, insurance companies, service providers we use and to whom we provide data, etc) courts or authorities. 

 

Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC). 

 

4.Retention of data 

 

We will not retain data longer than is necessary to fulfill our contractual or legal obligations and to defend against any liability claims. 

 

5. Information and deletion 

 

As a data subject, you have the right - under observance of the lawyer's duty of confidentiality - to information about your stored personal data, their origin and recipients and the purpose of data processing, as well as a right to correction, data transfer, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data. Insofar as there are changes to your personal data, we request that you inform us accordingly. With regard to the right to data portability, we would like to draw your attention to the fact that your personal data is processed using systems that are only machine-readable and interoperable to a limited extent. Therefore, we cannot guarantee a seamless transfer - for example, when changing to another law firm. 

6. Right of withdrawal 

 

You have the right to revoke any consent you may have given for the use of your personal data at any time. 

 

7. Notification and reporting of data protection violations 

 

We strive to ensure that data protection breaches are noticed at an early stage and notified to you without delay and, if necessary, reported to the competent supervisory authority, including the categories of data concerned.

 

8. Right of Complaint 

 

If you believe that the processing of your personal data by us violates applicable data protection law or that your data protection rights have been violated in any other way, you have the right to complain to the competent supervisory authority. In Austria, the data protection authority is responsible for this. 

 

9. Profiling 

 

Profiling or automated decision-making does not take place.

 

10. Events 

 

Our events, workshops and lectures 

 

provide you with detailed information about the latest developments in various areas of law and also allow you to network with industry participants and meet our attorneys in person. We only use your contact information to send invitations and process your name, company and position in our legitimate interest to optimize contact management.

 

11. Website 

 

a) Social media buttons

 

On our website, you will find social media buttons that you can use to share news articles or get more information about our lawyers. The respective social media logos are merely share buttons of these social networks. They contain a link to the corresponding social network. By clicking on the corresponding graphic, you will be redirected to the services of the respective network. Direct contact between the respective social network and the visitor to this website is only established when the visitor actively clicks on the social media button. Only then will the visitor's data be transmitted to the respective social network. If, on the other hand, the social media button is not clicked, no exchange takes place between the visitor and the social networks. This data processing is carried out on the basis of Art 6 para 1 S 1 lit f GDPR to protect the legitimate interests of the website operator, namely the optimization of its offer.

 

b) Google Analytics 

 

On our website, we use Google Analytics. However, this function is only used if you have consented to this via the button in the cookie banner. Google Analytics is a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin, Ireland (for this section "Google"). 

 

In Google Analytics, interactions of visitors to this website are primarily recorded with the help of cookies. These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website (including your IP address, a unique identifier, data from your browser and the URLs of the websites you visit) will be transmitted to and stored by Google on servers in the United States (including). Recipients in the USA may be: Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA or also Alphabet Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. The website operator does not store any of your data collected in connection with Google Analytics. On behalf of the website operator, Google will use this information for the purpose of evaluating your use of the website on a pseudonymous basis, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. According to Google, the IP address transmitted by your browser as part of Google Analytics is not merged with other data. On this website, IP anonymization is activated for Google Analytics. This means that your IP address is shortened and anonymized, so that traceability is fundamentally not possible, although we cannot rule out the possibility that this anonymization only takes place in the USA. Please note that in the USA there is no adequate level of data protection as in the EU and it cannot be ruled out that US authorities will have access to your data. 

 

c) Google AdWords and Google Conversion Tracking

 

This website uses Google AdWords. AdWords is an online advertising program of Google Inc, 1600 Amphitheater Parkway, Mountain View, CA 94043, United States (for this section "Google"). As part of Google AdWords, we use the so-called conversion tracking. When you click on an ad placed by Google, a cookie is set for conversion tracking. Cookies are small text files that your internet browser stores on your computer. These cookies expire after 30 days and are not used to personally identify the user. If the user visits certain pages of the website and the cookie has not yet expired, Google and the website can recognize that the user clicked on the ad and was redirected to that page. Each Google AdWords ad client has a different cookie. So cookies cannot be tracked across an AdWords customer's website. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted in to conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, advertisers do not receive information that can be used to personally identify users. If you do not want to participate in the tracking, you can simply disable the Google conversion tracking cookie by changing your browser settings. This way, you will not be included in the conversion tracking statistics. The storage of conversion cookies is based on Art 6 para 1 (f) GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising.

d) Google Maps and Apple Maps 

 

This website uses the map service Google Maps and Apple Maps via an API. This is operated by Google Inc. with headquarters at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA and by Apple with headquarters at One Apple Park Way, Cupertino, CA 95014, USA. To use Google Maps or Apple Maps, it is necessary to store your IP address. This information is usually transferred to a Google or Apple server in the USA and stored there. The operator of this site has no influence on this data transmission. The use of Google Maps or Apple Maps is in the interest of an attractive design of our website and to facilitate the location of the places indicated by us on the website. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f) GDPR. e) Cookies

 

When visiting the website, you will be asked if you agree to the use of "Google Analytics". If you click "I accept", you give your consent to this. If you click "Reject all", you decline. In both cases, a functional cookie will be set on your device to store the choices you have made. If you have given consent, Google Analytics will set additional cookies to perform the functions described above. You can also prevent the setting of cookies by selecting the appropriate settings on your browser software. In this case, however, you may not be able to use all functions of this website to their full extent. 

f) Server log files

 

In order to optimize this website with regard to system performance, user-friendliness and the provision of useful information about our services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your Internet Protocol address (IP address), browser and language settings, operating system, referrer URL, your Internet service provider and date/time. We do not merge this data with personal data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.

 

g) Data security 

 

Your personal data is protected by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, illegal or even accidental access, processing, loss, use and manipulation. Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information you disclose to us via the Internet may be viewed and used by other persons. Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (eg hacking attack on email account or telephone, interception of faxes).
